第一章 總 則
Chapter I General Provisions

第一條 為了加強(qiáng)進(jìn)出口商品檢驗(yàn)工作，保證進(jìn)出口商品的質(zhì)量，維護(hù)對外貿(mào)易有關(guān)各方的合法權(quán)益，促進(jìn)對外經(jīng)濟(jì)貿(mào)易關(guān)系的順利發(fā)展，制定本法。
Article 1 This Law is enacted with a view to strengthening the inspection of import and export commodities, ensuring the quality of import and export commodities, protecting the lawful rights and interests of the parties involved in foreign trade, and promoting the smooth development of China's economic and trade relations with foreign countries.

第二條 國務(wù)院設(shè)立進(jìn)出口商品檢驗(yàn)部門（以下簡稱國家商檢部門），主管全國進(jìn)出口商品檢驗(yàn)工作。
Article 2 The State Council shall establish an Administration for Import and Export Commodity Inspection (hereinafter referred to as the State Administration for Commodity Inspection), which shall be in charge of the inspection of import and export commodities throughout the country.

國家商檢部門設(shè)在各地的進(jìn)出口商品檢驗(yàn)機(jī)構(gòu)（以下簡稱商檢機(jī)構(gòu)）管理所轄地區(qū)的進(jìn)出口商品檢驗(yàn)工作。
The local import and export commodity inspection authorities (hereinafter referred to as the commodity inspection authorities) set up by the State Administration for Commodity Inspection shall be responsible for the inspection of import and export commodities within areas under their jurisdiction.

第三條 商檢機(jī)構(gòu)和國家商檢部門、商檢機(jī)構(gòu)指定的檢驗(yàn)機(jī)構(gòu)，依法對進(jìn)出口商品實(shí)施檢驗(yàn)。
Article 3 The commodity inspection authorities and other inspection organizations designated by the State Administration for Commodity Inspection and the commodity inspection authorities shall, in accordance with the law, perform the inspection of import and export commodities.

第四條 國家商檢部門根據(jù)對外貿(mào)易發(fā)展的需要，制定、調(diào)整并公布《商檢機(jī)構(gòu)實(shí)施檢驗(yàn)的進(jìn)出口商品種類表》（以下簡稱《種類表》）。
Article 4 The State Administration for Commodity Inspection shall, in the light of the needs in the development of foreign trade, make, adjust and publish a List of Import and Export Commodities Subject to Inspection by the Commodity Inspection Authorities (hereinafter referred to as the List of Commodities).

第五條 列入《種類表》的進(jìn)出口商品和其他法律、行政法規(guī)規(guī)定須經(jīng)商檢機(jī)構(gòu)檢驗(yàn)的進(jìn)出口商品，必須經(jīng)過商檢機(jī)構(gòu)或者國家商檢部門、商檢機(jī)構(gòu)指定的檢驗(yàn)機(jī)構(gòu)檢驗(yàn)。
Article 5 Import and export commodities which are included in the List of Commodities and import and export commodities subject to inspection by the commodity inspection authorities under other laws or administrative rules and regulations must be inspected by the commodity inspection authorities or inspection organizations designated by the State Administration for Commodity Inspection or the commodity inspection authorities.

前款規(guī)定的進(jìn)口商品未經(jīng)檢驗(yàn)的，不準(zhǔn)銷售、使用；前款規(guī)定的出口商品未經(jīng)檢驗(yàn)合格的，不準(zhǔn)出口。
No permission shall be granted for the sale or use of import commodities specified in the preceding paragraph until they have undergone inspection; and no permission shall be granted for the export of export commodities specified in the preceding paragraph until they have been found to be up to standard through inspection.

本條第一款規(guī)定的進(jìn)出口商品，經(jīng)收貨人、發(fā)貨人申請，國家商檢部門審查批準(zhǔn)，可以免予檢驗(yàn)。
Import and export commodities specified in the first paragraph of this Article may be exempted from inspection upon the examination and approval of an application from the consignee or consignor by the State Administration for Commodity Inspection.

第六條 商檢機(jī)構(gòu)實(shí)施進(jìn)出口商品檢驗(yàn)的內(nèi)容，包括商品的質(zhì)量、規(guī)格、數(shù)量、重量、包裝以及是否符合安全、衛(wèi)生要求。法律、行政法規(guī)規(guī)定有強(qiáng)制性標(biāo)準(zhǔn)或者其他必須執(zhí)行的檢驗(yàn)標(biāo)準(zhǔn)的進(jìn)出口商品，依照法律、行政法規(guī)規(guī)定的檢驗(yàn)標(biāo)準(zhǔn)檢驗(yàn)；法律、行政法規(guī)未規(guī)定有強(qiáng)制性標(biāo)準(zhǔn)或者其他必須執(zhí)行的檢驗(yàn)標(biāo)準(zhǔn)的，依照對外貿(mào)易合同約定的檢驗(yàn)標(biāo)準(zhǔn)檢驗(yàn)。
Article 6 Inspection on import and export commodities performed by the commodity inspection authorities shall cover quality, specifications, quantity, weight, packing and the requirements for safety and hygiene. Import and export commodities governed by compulsory standards or other inspection standards which must be complied with as provided for by laws or administrative rules and regulations shall be inspected in accordance with such inspection standards; in the absence of such stipulations, import and export commodities shall be inspected in accordance with the inspection standards agreed upon in the foreign trade contracts.

第七條 法律、行政法規(guī)規(guī)定由其他檢驗(yàn)機(jī)構(gòu)實(shí)施檢驗(yàn)的進(jìn)出口商品或者檢驗(yàn)項(xiàng)目，依照有關(guān)法律、行政法規(guī)的規(guī)定辦理。
Article 7 Import and export commodities or items subject to inspection by other inspection organizations under laws or administrative rules and regulations shall be inspected in accordance with the provisions of relevant laws or administrative rules and regulations.

第八條 國家商檢部門和商檢機(jī)構(gòu)應(yīng)當(dāng)收集和向有關(guān)方面提供進(jìn)出口商品檢驗(yàn)方面的信息。
Article 8 The State Administration for Commodity Inspection and the commodity inspection authorities shall collect information on the inspection of import and export commodities and make it available to the relevant circles.

第二章 進(jìn)口商品的檢驗(yàn)
Chapter II Inspection of Import Commodities

第九條 本法規(guī)定必須經(jīng)商檢機(jī)構(gòu)檢驗(yàn)的進(jìn)口商品的收貨人，必須向卸貨口岸或者到達(dá)站的商檢機(jī)構(gòu)辦理進(jìn)口商品登記。
Article 9 For import commodities which are subject to inspection by the commodity inspection authorities in accordance with this Law, the consignee must register them with the commodity inspection authorities located at the port of discharge or the station of arrival.

對列入《種類表》的進(jìn)口商品，海關(guān)憑商檢機(jī)構(gòu)在報關(guān)單上加蓋的印章驗(yàn)放。
Import commodities which are included in the List of Commodities shall be checked and released by the Customs upon presentation of the seal of the commodity inspection authorities affixed to the Customs declaration.

第十條 本法規(guī)定必須經(jīng)商檢機(jī)構(gòu)檢驗(yàn)的進(jìn)口商品的收貨人，應(yīng)當(dāng)在商檢機(jī)構(gòu)規(guī)定的地點(diǎn)和期限內(nèi)，向商檢機(jī)構(gòu)報驗(yàn)。
Article 10 For import commodities which are subject to inspection by the commodity inspection authorities in accordance with this Law, the consignee shall apply to the same authorities for inspection in places and within the time limit specified by them.

商檢機(jī)構(gòu)應(yīng)當(dāng)在對外貿(mào)易合同約定的索賠期限內(nèi)檢驗(yàn)完畢，并出具證明。
The commodity inspection authorities shall accomplish the procedures for inspection and issue an inspection certificate within the period of validity of claims prescribed in a foreign trade contract.

第十一條 本法規(guī)定必須經(jīng)商檢機(jī)構(gòu)檢驗(yàn)的進(jìn)口商品以外的進(jìn)口商品的收貨人，發(fā)現(xiàn)進(jìn)口商品質(zhì)量不合格或者殘損短缺，需要由商檢機(jī)構(gòu)出證索賠的，應(yīng)當(dāng)向商檢機(jī)構(gòu)申請檢驗(yàn)出證。
Article 11 If import commodities other than those which are subject to inspection by the commodity inspection authorities in accordance with this Law are found to be not up to the quality standard, damaged or short on weight or quantity, the consignee shall apply to the commodity inspection authorities for inspection and the issuance of an inspection certificate if such a certificate is necessary for claiming compensation.

第十二條 對重要的進(jìn)口商品和大型的成套設(shè)備，收貨人應(yīng)當(dāng)依據(jù)對外貿(mào)易合同約定在出口國裝運(yùn)前進(jìn)行預(yù)檢驗(yàn)、監(jiān)造或者監(jiān)裝，主官部門應(yīng)當(dāng)加強(qiáng)監(jiān)督；
Article 12 For important import commodities and a complete set of equipment in large size, the consignee shall, in accordance with the terms agreed upon in a foreign trade contract, conduct initial inspection or initial supervision over manufacturing or loading in the exporting country before shipment, while the relevant competent departments shall strengthen their supervision.

商檢機(jī)構(gòu)根據(jù)需要可以派出檢驗(yàn)人員參加。
The commodity inspection authorities may, when necessary,dispatch inspection personnel to take part in such inspection and supervision.

第三章 出口商品的檢驗(yàn)
Chapter III Inspection of Export Commodities

第十三條 本法規(guī)定必須經(jīng)商檢機(jī)構(gòu)檢驗(yàn)的出口商品的發(fā)貨人，應(yīng)當(dāng)在商檢機(jī)構(gòu)規(guī)定的地點(diǎn)和期限內(nèi)，向商檢機(jī)構(gòu)報驗(yàn)。商檢機(jī)構(gòu)應(yīng)當(dāng)在不延誤裝運(yùn)的期限內(nèi)檢驗(yàn)完畢，并出具證明。
Article 13 For export commodities which are subject to inspection by the commodity inspection authorities in accordance with this Law, the consignor shall apply to the same authorities for inspection in the places and within the time limit specified by them. The commodity inspection authorities shall accomplish the procedures for inspection and issue a certificate without delaying the prescribed time for shipment.

對列入《種類表》的出口商品，海關(guān)憑商檢機(jī)構(gòu)簽發(fā)的檢驗(yàn)證書、放行單或者在報關(guān)單上加蓋的印章驗(yàn)放。
Export commodities which are included in the List of Commodities shall be checked and released by the Customs upon presentation of the inspection certificate or the paper for release issued by the commodity inspection authorities or the seal of the same authorities affixed to the Customs declaration.

第十四條 經(jīng)商檢機(jī)構(gòu)檢驗(yàn)合格發(fā)給檢驗(yàn)證書或者放行單的出口商品，應(yīng)當(dāng)在商檢機(jī)構(gòu)規(guī)定的期限內(nèi)報運(yùn)出口；超過期限的，應(yīng)當(dāng)重新報驗(yàn)。
Article 14 Export commodities which have been inspected and passed by the commodity inspection authorities and for which an inspection certificate or a paper for release has been issued by the same authorities shall be declared for export and shipped out of the country within the time limit specified by the same authorities. Failing to meet the time limit shall entail reapplication for inspection.

第十五條 為出口危險貨物生產(chǎn)包裝容器的企業(yè)，必須申請商檢機(jī)構(gòu)進(jìn)行包裝容器的性能鑒定。
Article 15 An enterprise manufacturing packagings for dangerous export goods must apply to the commodity inspection authorities for a test of the performance of such packagings.

生產(chǎn)出口危險貨物的企業(yè)，必須申請商檢機(jī)構(gòu)進(jìn)行包裝容器的使用鑒定。使用未經(jīng)鑒定合格的包裝容器的危險貨物，不準(zhǔn)出口。
An enterprise producing dangerous export goods must apply to the same authorities for a test of the use of packagings. No permission shall be granted for the export of dangerous goods kept in packagings which have not passed a test.

第十六條 對裝運(yùn)出口易腐爛變質(zhì)食品的船艙和集裝箱，承運(yùn)人或者裝箱單位必須在裝貨前申請檢驗(yàn)。未經(jīng)檢驗(yàn)合格的，不準(zhǔn)裝運(yùn)。
Article 16 For vessel holds or containers used for carrying perishable foods, the carrier or the organization using the containers shall apply for inspection before loading. No permission shall be granted for loading and shipment until the relevant conditions are passed by the inspectors.

第四章 監(jiān)督管理
Chapter IV Supervision and Administration

第十七條 商檢機(jī)構(gòu)對本法規(guī)定必須經(jīng)商檢機(jī)構(gòu)檢驗(yàn)的進(jìn)出口商品以外的進(jìn)出口商品，可以抽查檢驗(yàn)。
Article 17 The commodity inspection authorities may make a random inspection of import and export commodities beyond those subject to inspection by the commodity inspection authorities in accordance with this Law.

出口商品經(jīng)抽查檢驗(yàn)不合格的，不準(zhǔn)出口。
No permission shall be granted for the export of export commodities found to be substandard in a random inspection.

第十八條 商檢機(jī)構(gòu)根據(jù)檢驗(yàn)工作的需要，可以向列入《種類表》的出口商品的生產(chǎn)企業(yè)派出檢驗(yàn)人員，參與監(jiān)督出口商品出廠前的質(zhì)量檢驗(yàn)工作。
Article 18 The commodity inspection authorities may, when necessary, assign inspection personnel to manufacturers of export commodities which are included in the List of Commodities to take part in supervision over the quality inspection of export commodities before they leave the factory.

第十九條 商檢機(jī)構(gòu)可以根據(jù)國家商檢部門同外國有關(guān)機(jī)構(gòu)簽訂的協(xié)議或者接受外國有關(guān)機(jī)構(gòu)的委托進(jìn)行進(jìn)出口商品質(zhì)量認(rèn)證工作，準(zhǔn)許在認(rèn)證合格的進(jìn)出口商品上使用質(zhì)量認(rèn)證標(biāo)志。
Article 19 The commodity inspection authorities may undertake the quality certification of import and export commodities on the basis of agreements signed between the State Administration for Commodity Inspection and the foreign bodies concerned or upon entrustment by the foreign bodies concerned. They may permit the use of quality certification marks on import and export commodities which have been given quality certification.

第二十條 國家商檢部門和商檢機(jī)構(gòu)根據(jù)檢驗(yàn)工作的需要，通過考核，認(rèn)可符合條件的國內(nèi)外檢驗(yàn)機(jī)構(gòu)承擔(dān)委托的進(jìn)出口商品檢驗(yàn)工作。
Article 20 The State Administration for Commodity Inspection and the commodity inspection authorities shall, on the basis of the requirements in their inspection, entrust competent inspection organizations at home and abroad with the inspection of import and export commodities after examining their qualifications.

第二十一條 國家商檢部門和商檢機(jī)構(gòu)對其指定或者認(rèn)可的檢驗(yàn)機(jī)構(gòu)的進(jìn)出口商品檢驗(yàn)工作進(jìn)行監(jiān)督，可以對其檢驗(yàn)的商品抽查檢驗(yàn)。
Article 21 The State Administration for Commodity Inspection and the Commodity inspection authorities shall exercise supervision over the import and export commodity inspection conducted by the inspection organizations designated or approved by them and may make a random inspection of the commodities which have been inspected by such organization.

第二十二條 國家根據(jù)需要，對重要的進(jìn)出口商品及其生產(chǎn)企業(yè)實(shí)行質(zhì)量許可制度，具體辦法由國家商檢部門會同國務(wù)院有關(guān)主管部門制定。
Article 22 The State shall, when necessary, institute a quality licence system for important import and export commodities and their manufacturers. The specific measures thereof shall be drawn up by the State Administration for Commodity Inspection in conjunction with the relevant competent departments under the State Council.

第二十三條 商檢機(jī)構(gòu)根據(jù)需要，對檢驗(yàn)合格的進(jìn)出口商品，可以加施商檢標(biāo)志或者封識。
Article 23 The commodity inspection authorities may, when necessary, place commodity inspection marks or sealings on import and export commodities proved to be up to standard through inspection.

第二十四條 進(jìn)出口商品的報驗(yàn)人對商檢機(jī)構(gòu)作出的檢驗(yàn)結(jié)果有異議的，可以向原商檢機(jī)構(gòu)或者其上級商檢機(jī)構(gòu)以至國家商檢部門申請復(fù)驗(yàn)，由受理復(fù)驗(yàn)的商檢機(jī)構(gòu)或者國家商檢部門作出復(fù)驗(yàn)結(jié)論。
Article 24 In case an applicant for the inspection of import and export commodities disagrees with the results of inspection presented by the commodityinspection authorities, he may apply for reinspection to the same authorities, to those at the next higher level or to the State Administration for Commodity Inspection. The conclusion on reinspection shall be made by the commodity inspection authorities or the State Administration for Commodity Inspection which has accepted the application for reinspection.

第二十五條 商檢機(jī)構(gòu)和其指定的檢驗(yàn)機(jī)構(gòu)以及經(jīng)國家商檢部門批準(zhǔn)的其他檢驗(yàn)機(jī)構(gòu)，可以接受對外貿(mào)易關(guān)系人或者外國檢驗(yàn)機(jī)構(gòu)的委托，辦理進(jìn)出口商品鑒定業(yè)務(wù)。進(jìn)出口商品鑒定業(yè)務(wù)的范圍包括：
Article 25 The commodity inspection authorities, the inspection organizations designated by them and other inspection organizations approved by the State Administration for Commodity Inspection may handle the business of superintending and surveying import and export commodities as entrusted by parties involved in foreign trade or by foreign inspection bodies.The scope of business of superintending and surveying import and export commodities shall cover:

進(jìn)出口商品的質(zhì)量、數(shù)量、重量、包裝鑒定，海損鑒定，集裝箱檢驗(yàn)，進(jìn)口商品的殘損鑒定，出口商品的裝運(yùn)技術(shù)條件鑒定、貨載衡量、產(chǎn)地證明、價值證明以及其他業(yè)務(wù)。
inspection of the quality, quantity, weight and packing of import and export commodities; inspection of cargoes with respect to general or particular average; inspection of container cargoes;damage survey of import cargoes; inspection of technical conditions for the shipment of exports; measurement of dead tonnage; certification of the origin or value of exports and other superintending and surveying services.

第五章 法律責(zé)任
Chapter V Legal Responsibility

第二十六條 違反本法規(guī)定，對列入《種類表》的和其他法律、行政法規(guī)規(guī)定必須經(jīng)商檢機(jī)構(gòu)檢驗(yàn)的進(jìn)口商品未報經(jīng)檢驗(yàn)而擅自銷售或者使用的，對列入《種類表》的和其他法律、行政法規(guī)規(guī)定必須經(jīng)商檢機(jī)構(gòu)檢驗(yàn)的出口商品未報經(jīng)檢驗(yàn)合格而擅自出口的，由商檢機(jī)構(gòu)處以罰款；
Article 26 Anyone who, in violation of the relevant provisions of this Law, purposely markets or uses import commodities which are included in the List of Commodities or subject to inspection by the commodity inspection authorities in accordance with other laws or administrative rules and regulations without having such commodities inspected, or purposely exports export commodities which are included in the List of Commodities or subject to inspection by the commodity inspection authorities in accordance with other laws or administrative rules and regulations without having such commodities inspected and proved up to standard shall be fined by the commodity inspection authorities.

情節(jié)嚴(yán)重，造成重大經(jīng)濟(jì)損失的，對直接責(zé)任人員比照刑法第一百八十七條的規(guī)定追究刑事責(zé)任。
If the circumstances are serious and cause heavy economic losses, the criminal responsibility of the personnel directly responsible shall be investigated by applying mutatis mutandis the provisions of Article 187 of the Criminal Law.

違反本法第十七條的規(guī)定，對經(jīng)商檢機(jī)構(gòu)抽查檢驗(yàn)不合格的出口商品擅自出口的，依照前款的規(guī)定處罰。
Anyone who, in violation of the provisions of Article 17 of this Law, purposely exports export commodities which have been found substandard during a random inspection by the commodity inspection authorities, shall be punished in accordance with the provisions of the preceding paragraph.

第二十七條 偽造、變造商檢單證、印章、標(biāo)志、封識、質(zhì)量認(rèn)證標(biāo)志，構(gòu)成犯罪的，對直接責(zé)任人員比照刑法第一百六十七條的規(guī)定追究刑事責(zé)任；情節(jié)輕微的，由商檢機(jī)構(gòu)處以罰款。
Article 27 If the falsifying or remaking of the certificates or documents, seals or stamps, marks, sealings or quality certification marks for commodity inspection constitutes a crime, the criminal responsibility of the personnel directly responsible shall be investigated by applying mutatis mutandis the provisions of Article 167 of the Criminal Law; if the circumstances are minor, the offender shall be fined by the commodity inspection authorities.

第二十八條 當(dāng)事人對商檢機(jī)構(gòu)的處罰決定不服的，可以自收到處罰通知之日起三十天內(nèi)，向作出處罰決定的商檢機(jī)構(gòu)或者其上級商檢機(jī)構(gòu)或者國家商檢部門申請復(fù)議；
Article 28 If a party refuses to accept the punishment decision of the commodity inspection authorities, he may, within 30 days of receiving the notice on the punishment, apply for reconsideration to the same authorities which have made the punishment decision, to those at the next higher level or to the State Administration for Commodity Inspection.

對復(fù)議決定不服的，可以自收到復(fù)議決定書之日起三十天內(nèi)，向法院起訴。當(dāng)事人逾期不申請復(fù)議或者不起訴又拒不履行的，由作出處罰決定的商檢機(jī)構(gòu)申請法院強(qiáng)制執(zhí)行。
If the party refuses to accept the decision on the reconsideration, he may, within 30 days of receiving the notice on the reconsideration decision, bring a suit nor complies with the punishment decision within the prescribed time limit,the commodity inspection authorities which have made the punishment decision shall apply to a court of law for compulsory execution.

第二十九條 國家商檢部門、商檢機(jī)構(gòu)的工作人員和國家商檢部門、商檢機(jī)構(gòu)指定的檢驗(yàn)機(jī)構(gòu)的檢驗(yàn)人員，濫用職權(quán)，徇私舞弊，偽造檢驗(yàn)結(jié)果的，或者玩忽職守，延誤檢驗(yàn)出證的，根據(jù)情節(jié)輕重，給予行政處分或者依法追究刑事責(zé)任。
Article 29 Any functionary of the State Administration for Commodity Inspection or of the commodity inspection authorities or any of the inspection personnel of the inspection organizations designated by the State Administration for Commodity Inspection and the commodity inspection authorities who abuses his power, commits irregularities for the benefit of his relatives or friends, falsifies inspection results or fails to conduct inspection and issue a certificate within the time limit through dereliction shall, depending on the seriousness of the circumstances, be given administrative sanction, or his criminal responsibility shall be investigated according to law.

第六章 附 則
Chapter VI Supplementary Provisions

第三十條 商檢機(jī)構(gòu)和其他檢驗(yàn)機(jī)構(gòu)依照本法的規(guī)定實(shí)施檢驗(yàn)和辦理鑒定業(yè)務(wù)，依照規(guī)定收費(fèi)。
Article 30 The commodity inspection authorities and other inspection organizations shall collect fees according to relevant provisions for carrying out inspection or performing superintending and surveying services in accordance with the provisions of this Law.

收費(fèi)辦法由國家商檢部門會同國務(wù)院有關(guān)主管部門制定。
The procedures for collecting fees shall be drawn up by the State Administration for Commodity Inspection in conjunction with the competent departments under the State Council.

第三十一條 國家商檢部門根據(jù)本法制定實(shí)施辦法，報國務(wù)院批準(zhǔn)后施行。
Article 31 Rules for the implementation of this Law shall be formulated by the State Administration for Commodity Inspection and shall come into force after being submitted to and approved by the State Council.

第三十二條 本法自１９８９年８月１日起施行。１９８４年１月２８日國務(wù)院發(fā)布的《中華人民共和國進(jìn)出口商品檢驗(yàn)條例》同時廢止。
Article 32 This Law shall come into force as of August 1, 1989. The Regulations of the People's Republic of China on the Inspection of Import and Export Commodities promulgated by the State Council on January 28, 1984 shall be invalidated as of the same date.
